Welcome to Indus Mart Pvt. Ltd. ("Indus Mart", "we", "us", or "our"). By accessing or using our website theindusmart.com (the "Site") or purchasing products from us, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully before using our services.

1. General Conditions

By using our Site, you confirm that you are at least 18 years of age or are accessing the Site under the supervision of a parent or legal guardian. You agree not to use our products for any unlawful purpose and agree to comply with all applicable laws and regulations of Nepal.

We reserve the right to refuse service to anyone for any reason at any time. We may update or modify these Terms at any time without prior notice. Your continued use of the Site after any changes constitutes acceptance of the updated Terms.

2. Products and Services

Indus Mart is an industrial supply company selling tools, machinery, safety equipment, hydraulic components, welding products, fasteners, measuring instruments, and related industrial goods. We make every effort to display product colours, images, and descriptions as accurately as possible. However, we cannot guarantee that your computer monitor or mobile device display of any colour, image, or detail will be fully accurate.

We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products, pricing, and availability are subject to change at any time without notice, at our sole discretion.

3. Pricing and Payment

All prices displayed on our Site are in Nepalese Rupees (NPR) and are inclusive of applicable taxes unless stated otherwise. Prices are subject to change without prior notice.

We accept payment via eSewa, Khalti, bank transfer (NEFT/RTGS), cheque, and cash (for in-store purchases). Payment must be received in full before products are dispatched, unless otherwise agreed in writing for B2B accounts.

We reserve the right to refuse or cancel any order at any time for reasons including but not limited to: product availability, errors in product or pricing information, or suspected fraudulent or unauthorised transactions.

4. Order Acceptance and Confirmation

Placing an order on our Site constitutes an offer to purchase. We reserve the right to accept or decline your order. An order confirmation email or WhatsApp message does not constitute acceptance of your order. Acceptance occurs when we dispatch the product and provide a shipping confirmation.

In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel the order for a full refund.

5. Shipping and Delivery

We deliver to all 77 districts of Nepal. Delivery timelines and shipping charges vary by location, product weight, and dimensions. Estimated delivery times are provided at checkout and are not guaranteed. Indus Mart is not responsible for delays caused by courier services, natural disasters, strikes, or other events beyond our control.

Risk of loss and title for products passes to you upon delivery to the shipping carrier. Please inspect your order upon receipt and report any damage or discrepancies within 24 hours.

6. Returns and Refunds

Our Return and Refund Policy, available at theindusmart.com/policies/refund-policy, forms part of these Terms of Service. Please review it before making a purchase.

7. Accuracy of Information

While we strive to provide accurate, current, and complete information on our Site, we do not warrant that the content — including product descriptions, specifications, pricing, stock availability, or other information — is always accurate, complete, or current. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice.

All content on this Site — including but not limited to text, graphics, logos, images, product photographs, and software — is the property of Indus Mart Pvt. Ltd. or its content suppliers and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or republish any content from our Site without our prior written consent.

All third-party brand names, logos, and trademarks (such as DeWalt, Taparia, Continental, Leo Pumps, Mitutoyo, etc.) displayed on our Site are the property of their respective owners and are used for product identification purposes only.

You agree not to:

  • Use the Site for any illegal or unauthorised purpose
  • Attempt to gain unauthorised access to any portion of the Site or its systems
  • Upload or transmit viruses, malware, or any other malicious code

Our total liability for any claim arising from a purchase shall not exceed the amount paid by you for the specific product giving rise to the claim.

You agree to indemnify, defend, and hold harmless Indus Mart Pvt. Ltd., its directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Site or violation of these Terms.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nepal. Any disputes arising from these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the courts in Biratnagar, Koshi Province, Nepal.

14. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.
